1. Introduction

Welcome to Haris (حارس).

These Terms and Conditions ("Terms") govern your access to and use of the Haris platform, including the Haris parent application, the Haris child application, the Haris website, and any related services (collectively, the "Services").

Haris is a digital child safety platform designed to assist parents and legal guardians in protecting children through privacy-first technologies, including on-device artificial intelligence, while minimizing the collection and transmission of sensitive information.

By creating an account, installing Haris, pairing a Protected Device (a smartphone, tablet, computer, wearable device, or other compatible device designated by a parent or legal guardian to receive the child safety, monitoring, parental control, artificial intelligence, or other functionality provided by the Services following successful installation, authorization, configuration, and pairing), accessing, or otherwise using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by the Haris Privacy Policy ("Privacy Policy"), which is incorporated into these Terms by reference.

If you do not agree to these Terms, you must not access or use the Services.

1.1 Operator of the Services

Haris is currently operated by its founder until a legal entity is established. References in these Terms to "Haris," "we," "our," or "us" refer to the operator of the Haris platform at the time the Services are provided. If ownership or operation of Haris is transferred to a legal entity in the future, these Terms shall continue to apply, and references to the operator shall be deemed to refer to the successor entity responsible for providing the Services.

2. Acceptance of These Terms

By creating a Haris account, installing the Haris parent or child application, pairing a protected device, accessing, or otherwise using any part of the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and all applicable laws and regulations.

If you are accepting these Terms on behalf of a child under your care, you represent and warrant that you are the child's parent or legal guardian or otherwise have the legal authority to supervise the child's use of the Services and to accept these Terms on the child's behalf.

If you do not agree to these Terms, or if you do not have the legal authority to accept them, you must not create an account, install Haris, pair a protected device, or use any part of the Services.

Your continued use of Haris after any updates to these Terms constitutes acceptance of the revised Terms, except where applicable law requires your explicit consent before such changes become effective.

3. Eligibility and Authorized Use

Haris is intended solely for use by adults who are at least eighteen (18) years of age and who have the legal authority to supervise a child under their care. By creating a Haris account or using the Services, you represent and warrant that you satisfy these eligibility requirements.

Where these Terms refer to a "child," the term means an individual who has not reached the age of legal majority under the laws applicable in the user's jurisdiction, unless otherwise required by applicable law.

Haris is designed exclusively to assist parents and legal guardians in protecting children through responsible and transparent digital safety tools. Haris is not intended to facilitate covert surveillance, unauthorized monitoring, or any activity that violates applicable laws or the privacy rights of others.

You agree to use Haris only for lawful purposes and in accordance with these Terms. Without limitation, you agree that you will not use Haris to:

  • Monitor an adult without that person's knowledge or lawful authorization.
  • Monitor employees, contractors, or other individuals in the workplace unless such use is expressly permitted by applicable law.
  • Engage in stalking, harassment, intimidation, or any other abusive or unlawful conduct.
  • Circumvent or interfere with Android security features, platform restrictions, or other technical safeguards.
  • Use Haris in any manner that infringes the rights, privacy, or freedoms of any individual.
  • Misrepresent your identity or falsely claim to be a parent or legal guardian of a protected child.
  • Use Haris in violation of any applicable local, national, or international law or regulation.

Haris is available for use worldwide only where its installation and use are permitted by applicable law. Users are solely responsible for ensuring that their use of Haris complies with all laws and regulations applicable in their jurisdiction.

Haris reserves the right to suspend or terminate access to the Services if it reasonably believes that the Services are being used in violation of these Terms or applicable law.

Users may access and use the Services only where such access and use are permitted under applicable laws and regulations. Users represent and warrant that they are not located in, ordinarily resident in, or subject to any jurisdiction where the provision or use of the Services is prohibited by applicable export control laws, economic sanctions, trade restrictions, or other legal requirements. Users are solely responsible for complying with all applicable laws governing their access to and use of the Services.

4. Account Registration

To access certain features of Haris, users must create a valid account. Haris provides separate account registration and authentication mechanisms for parents, legal guardians, and protected child devices.

Users may register an account using one of the authentication methods made available by Haris, including:

  • Google Sign-In.
  • Phone number verification using a One-Time Password (OTP).
  • Other authentication methods that may be introduced in future versions of the Services.

Each Haris account must be registered using accurate, current, and complete information. Users agree to keep their account information updated and to promptly correct any inaccurate or outdated information.

Each account is personal to the registered user and may not be transferred, sold, assigned, shared, or made available to any other individual except as expressly permitted by the Services.

Users are responsible for maintaining the confidentiality of their authentication credentials, including passwords (where applicable), OTP verification methods, authentication devices, and any other credentials used to access their accounts. Users must promptly notify Haris if they become aware of any unauthorized access to, or suspected compromise of, their account.

Haris may refuse registration, suspend, restrict, or terminate an account if it reasonably believes that:

  • False, inaccurate, or misleading information has been provided.
  • The account is being used in violation of these Terms.
  • The account has been compromised or is being used fraudulently.
  • Continued access could compromise the security, integrity, or lawful operation of the Services.

Nothing in this section obligates Haris to create or maintain an account where doing so would violate applicable law or compromise the security of the platform or its users.

5. Parent and Child Accounts

Haris distinguishes between parent accounts and child accounts, each serving a distinct role within the Services. This separation is fundamental to the design and operation of the Haris platform.

Parents and legal guardians are responsible for creating and managing their own Haris accounts, as well as any protected child accounts associated with them.

A parent account provides access to account management, device pairing, parental controls, notification settings, protection modes, safety preferences, and other management features made available through the Services.

A child account is intended solely to identify a protected device and enable child safety features after it has been successfully paired with an authorized parent or legal guardian account. The existence of a child account alone does not activate monitoring, protection, or parental control features.

Monitoring and child safety functionality become available only after a protected device has been successfully paired with an authorized parent or legal guardian account using the pairing mechanisms provided by Haris. Until pairing has been completed, the child account functions only as a registered account and does not enable active monitoring or parental controls.

Parents and legal guardians are solely responsible for:

  • Pairing protected devices with their authorized parent account.
  • Configuring monitoring, protection, and parental control settings.
  • Selecting available protection modes and other safety preferences.
  • Reviewing notifications and locally stored safety-related information when appropriate.
  • Maintaining the confidentiality of authentication credentials, parental PINs, and other security mechanisms used to access protected content.
  • Ensuring that their use of Haris complies with these Terms, all applicable laws, and the rights and privacy of others.

Child accounts do not independently manage monitoring settings, parental controls, device pairing, or account administration unless such functionality is expressly introduced in a future version of the Services.

Haris does not verify legal custody, parental authority, guardianship, or other legal relationships beyond the information and representations provided during account registration. Users are solely responsible for ensuring that they possess the legal authority required to create, pair, and manage protected child accounts.

Parents and legal guardians acknowledge that Haris is designed to assist, rather than replace, active parental supervision. The effectiveness of the Services depends upon proper installation, successful device pairing, appropriate configuration of available safety features, ongoing parental involvement, and the technical capabilities and limitations of the supported operating system.

While Haris provides advanced child safety technologies, including on-device artificial intelligence, it should not be relied upon as the sole means of protecting children from digital or online risks. Parents and legal guardians remain responsible for exercising appropriate judgment, supervision, and care regarding their children's use of technology.

6. Device Pairing

Device pairing is a fundamental component of the Haris platform and establishes the trusted relationship between an authorized parent or legal guardian account and a protected child device. Child safety features are activated only after a protected device has been successfully paired using the pairing mechanisms provided by Haris.

Until the pairing process has been successfully completed, Haris's monitoring, parental controls, notifications, and other child safety features remain inactive. The existence of a registered child account alone does not activate monitoring or any parental protection features.

To establish a trusted relationship between a parent account and a protected device, Haris may require one or more verification methods, including a pairing code generated by the protected device or other authentication mechanisms that may be introduced in future versions of the Services. Haris reserves the right to modify, strengthen, or replace its pairing mechanisms as necessary to improve security, reliability, usability, or compliance with applicable laws and platform requirements.

Parents and legal guardians are solely responsible for ensuring that protected devices are paired only with accounts they are legally authorized to manage. Users must not attempt to pair, register, or monitor any device that they do not own, control, or otherwise have lawful authority to supervise.

A protected device may be unpaired, removed, or reassigned using the procedures made available through the Services. Unpairing a device immediately disables the monitoring relationship and associated child safety features between that protected device and the previously paired parent account unless and until a new authorized pairing is established.

Haris may refuse, suspend, restrict, or terminate a device pairing if it reasonably believes that the pairing was established fraudulently, without proper authorization, in violation of these Terms, or in a manner that could compromise the security, integrity, reliability, or lawful operation of the Services.

Device pairing is intended solely to establish a trusted relationship between an authorized parent or legal guardian account and a protected child device. Pairing does not transfer ownership of the protected device, grant Haris unrestricted control over the device, modify the operating system's security model, or alter the legal rights, responsibilities, or relationships of the device owner, parent, legal guardian, or child. Haris exercises only the functionality expressly authorized by the user through the permissions granted to the application and in accordance with these Terms, the Haris Privacy Policy, and applicable law.

7. Subscription and Fees

Haris currently provides its Services free of charge unless otherwise expressly stated within the application or through an official communication issued by Haris.

Haris reserves the right to introduce optional paid features, premium services, subscription plans, enterprise offerings, educational offerings, or other paid products and services in future versions of the Services. The introduction of optional paid services shall not affect the validity of these Terms, and any such services shall be subject to the pricing, billing, subscription, and other commercial terms presented to the user at the time of purchase.

Before a user purchases any paid service, Haris will clearly disclose all material commercial information applicable to that purchase, including, where relevant, pricing, billing frequency, subscription duration, automatic renewal terms, cancellation procedures, and any other material conditions required by applicable law.

Users are responsible for reviewing and accepting all applicable pricing, billing, and subscription information before completing a purchase.

Payments for optional paid services may be processed by authorized third-party payment providers or authorized application marketplaces selected by Haris. Haris does not store complete payment card information unless expressly stated and only where permitted by applicable law.

Failure to pay applicable subscription fees or other charges may result in the suspension, limitation, or termination of access to the affected paid features while preserving access to any Services that remain available without charge.

Unless otherwise required by applicable law or expressly stated at the time of purchase, subscription fees and other payments are non-refundable once the applicable paid service has been activated.

Where subscriptions or purchases are offered through an authorized application marketplace, including Google Play or other authorized distribution platforms, purchases, renewals, cancellations, refunds, and payment processing may additionally be governed by the policies, billing procedures, and terms of the applicable marketplace. In the event of any inconsistency relating to payment processing or subscription management, the applicable marketplace requirements shall govern to the extent required by that platform.

Nothing in this section obligates Haris to introduce paid services, maintain any specific pricing model, continue offering any subscription plan, preserve the availability of any free feature, or offer any particular functionality without charge. Haris reserves the right to introduce, modify, replace, suspend, or discontinue subscription plans, pricing structures, paid services, promotional offers, or commercial features upon reasonable notice and in accordance with applicable law.

8. License to Use the Services

Subject to these Terms and your continued compliance with all applicable laws and regulations, Haris grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install, access, and use the Services solely for their intended purpose of assisting parents and legal guardians in protecting children through the features made available by Haris.

This license authorizes you to use the Services only for your own lawful personal or family purposes unless Haris expressly authorizes another form of use in writing.

Except as expressly permitted by these Terms or by applicable law, you shall not:

  • Copy, reproduce, distribute, publish, lease, sublicense, sell, assign, or otherwise commercially exploit any part of the Services.
  • Modify, adapt, translate, create derivative works from, reverse engineer, decompile, disassemble, or otherwise attempt to discover or access the source code, software architecture, artificial intelligence models, algorithms, databases, security mechanisms, or any other proprietary technology used by Haris.

  • Use the Services or any part thereof to develop, train, benchmark, evaluate, improve, or support competing software, artificial intelligence systems, commercial services, or derivative products without the prior written authorization of Haris.
  • Use automated tools, bots, scripts, crawlers, scraping technologies, or similar automated methods to access, monitor, extract, or interfere with the Services except where expressly authorized by Haris.

Nothing in these Terms grants you ownership of the Services or any intellectual property rights relating to the Services. All rights, title, and interest in and to the Services, including all software, artificial intelligence models, algorithms, documentation, trademarks, branding, content, and other proprietary materials, remain the exclusive property of Haris and its operator or its licensors, as applicable.

Nothing in this license grants users any ownership interest in the Services or any right to access functionality beyond that made available through the user interface, the permissions expressly granted by the user, and the capabilities permitted by the supported operating system.

This license automatically terminates if you violate these Terms, if your account is suspended or terminated, or if Haris discontinues the relevant Services in accordance with these Terms.

Termination of this license does not affect any rights, obligations, or legal provisions that, by their nature or intended purpose, survive the termination of these Terms, including provisions relating to intellectual property, limitations of liability, dispute resolution, governing law, indemnification, and any accrued rights or obligations.

9. Prohibited Activities

To protect the security, integrity, reliability, availability, and lawful operation of the Services, users agree that they shall not engage in, encourage, facilitate, authorize, or attempt any activity that is prohibited by these Terms or applicable law.

Without limitation, users shall not:

  • Use the Services for any unlawful, fraudulent, harmful, abusive, deceptive, or unauthorized purpose.

  • Use the Services or any information obtained through the Services to develop, train, benchmark, evaluate, improve, or support competing software, artificial intelligence systems, commercial services, or derivative products without the prior written authorization of Haris.
  • Assist, encourage, instruct, authorize, or enable any other individual or organization to engage in any activity prohibited by these Terms.

Users shall not use the Services in any manner that could endanger children, interfere with legitimate parental supervision, undermine the intended child safety functions of the Services, or otherwise defeat the protective objectives for which Haris has been designed.

Haris reserves the right to investigate suspected violations of this section and may suspend, restrict, terminate, or otherwise limit access to the Services where it reasonably believes that prohibited activities have occurred. Haris may also take any additional action permitted by applicable law to protect the Services, its users, its infrastructure, and its legitimate business interests.

10. Device Permissions and Platform Functionality

The Services rely on certain operating system permissions, security mechanisms, and platform capabilities to provide their intended functionality. Depending on the features selected by the user, the supported operating system, and the capabilities of the protected device, Haris may request access to specific permissions that are reasonably necessary for the operation of the Services.

These permissions and platform capabilities may include, but are not limited to:

  • Accessibility Service.
  • Notification access.
  • Virtual Private Network (VPN) functionality.
  • Screenshot capture capabilities where supported by the operating system.
  • Foreground services.
  • Push notifications.
  • Network connectivity.
  • Other permissions, security mechanisms, or platform capabilities reasonably required to provide current or future features of the Services.

The availability, reliability, accuracy, and effectiveness of individual Haris features depend upon the permissions granted by the user, the capabilities of the supported operating system, device manufacturer restrictions, operating system security policies, hardware limitations, and other technical factors beyond Haris's reasonable control.

Users acknowledge that denying, revoking, restricting, or otherwise limiting permissions required by the Services may reduce, limit, or prevent the operation of certain Haris features. Haris shall not be responsible for any reduction in functionality resulting from permissions that have not been granted, have been withdrawn by the user, or have become unavailable because of operating system changes, device manufacturer restrictions, or other platform limitations.

Haris requests only those permissions that are reasonably necessary to provide the functionality selected by the user and operates solely within the security framework, permission model, and technical capabilities provided by the supported operating system.

Nothing in these Terms authorizes or requires Haris to bypass, circumvent, override, exploit, or interfere with the operating system's security protections, permission model, application sandboxing, hardware security features, or other platform security mechanisms.

As operating systems, platform policies, and security requirements evolve, Haris may request additional permissions, discontinue previously used permissions, or modify the permissions required for specific features where reasonably necessary to maintain compatibility, improve security, comply with legal or platform requirements, or introduce new functionality. Where required by applicable law or platform policies, users will be informed before newly required permissions are requested.

Haris is designed to operate transparently and only within the permissions knowingly granted by the user. The Services are not designed to obtain unauthorized access to device resources, circumvent operating system protections, perform hidden monitoring beyond the functionality disclosed to the user, or access information outside the permissions expressly granted by the user and supported by the operating system.

11. Artificial Intelligence and Automated Analysis

Haris incorporates artificial intelligence ("AI"), machine learning technologies, and other automated analysis techniques to assist parents and legal guardians in identifying potentially harmful digital content and supporting the child safety features provided by the Services.

The Services may utilize automated analysis technologies including, but not limited to:

  • Optical Character Recognition (OCR).
  • Image classification.
  • Cyberbullying detection.
  • Detection of potentially inappropriate, explicit, or harmful visual content.
  • Detection of potentially harmful or abusive communications.
  • Behavioral analysis related to child safety features.
  • Other artificial intelligence, machine learning, or automated analysis technologies that may be introduced in future versions of the Services.

Unless expressly stated otherwise, automated analysis is designed to operate primarily on the protected device using locally executed processing. This architecture is intended to minimize unnecessary transmission of monitored content while supporting the Privacy by Design, Security by Design, Data Minimization, and On-Device AI First principles described in the Haris Privacy Policy.

Artificial intelligence and automated analysis are intended solely to assist parents and legal guardians in identifying potential concerns. AI-generated analyses, classifications, recommendations, notifications, alerts, confidence assessments, and other automated outputs are informational in nature and should not be interpreted as definitive factual determinations, legal conclusions, professional advice, or guarantees regarding the existence or absence of harmful content or behavior.

Users acknowledge and accept that artificial intelligence and automated analysis technologies are inherently probabilistic and may produce false positives, false negatives, incomplete analyses, differing results, or inaccurate classifications depending upon numerous factors, including contextual information, language, image quality, operating system behavior, device capabilities, environmental conditions, user interactions, and future improvements to the Services.

Parents and legal guardians remain solely responsible for reviewing alerts, evaluating available information, exercising independent judgment, and determining the appropriate response based on the specific circumstances. Haris is designed to support, but not replace, active parental supervision, human judgment, professional advice where appropriate, or responsible decision-making.

Haris may improve, retrain, replace, update, suspend, or discontinue artificial intelligence models, machine learning technologies, automated analysis techniques, or related detection capabilities to improve security, reliability, performance, accuracy, regulatory compliance, platform compatibility, or child safety functionality. Such changes do not alter the fundamental rights and obligations established under these Terms unless otherwise expressly communicated by Haris.

Nothing in this section, these Terms, or the Services shall be interpreted as guaranteeing that Haris will detect, classify, prevent, or report every instance of harmful, inappropriate, illegal, unsafe, abusive, or otherwise undesirable content, communication, image, behavior, or activity. Users acknowledge that no artificial intelligence system, automated technology, or child safety platform can provide complete, uninterrupted, or error-free detection under all circumstances.

The Services are intended to assist parents and legal guardians in supporting child safety and informed decision-making. The Services do not provide legal, medical, psychological, psychiatric, educational, law enforcement, cybersecurity, or other professional advice and should not be relied upon as a substitute for qualified professional judgment where such advice or intervention is appropriate. Users remain solely responsible for seeking professional assistance whenever circumstances reasonably require it.

12. Parent Responsibilities and Ongoing Obligations

Parents and legal guardians remain solely responsible for the supervision, care, safety, and digital well-being of the children under their authority. Haris is designed to assist parents and legal guardians through technology but does not replace active parental involvement, supervision, judgment, decision-making, or the exercise of parental responsibilities.

Throughout their use of the Services, parents and legal guardians agree to:

  • Install, configure, maintain, and use the Services in accordance with these Terms and any instructions or guidance provided by Haris.
  • Ensure that protected devices remain properly paired, configured, and maintained to support the intended operation of the Services.

  • Use the Services only in a lawful, responsible, transparent, ethical, and good-faith manner.
  • Respect the rights, privacy, dignity, and lawful interests of children and all other individuals affected by the use of the Services.
  • Promptly remove monitoring where continued monitoring is no longer authorized, appropriate, or legally permitted.
  • Comply with all applicable laws, regulations, court orders, parental responsibility requirements, and other legal obligations relating to the supervision and protection of children.

Parents and legal guardians acknowledge that the effectiveness of the Services depends upon numerous factors beyond Haris's reasonable control, including proper installation, successful device pairing, permissions granted by the user, operating system capabilities, device compatibility, network availability, user actions, environmental conditions, evolving digital threats, and the inherent limitations of artificial intelligence and automated analysis technologies.

Where Haris identifies potentially harmful activity or generates alerts, notifications, or automated analyses, parents and legal guardians remain solely responsible for evaluating the available information, exercising independent judgment, and determining the appropriate response based upon the specific circumstances. Haris does not make parenting decisions, provide legal, medical, psychological, or educational advice, replace professional guidance, or assume responsibility for actions taken or not taken by users in response to information provided by the Services.

Parents and legal guardians are responsible for ensuring that children using devices protected by Haris are informed of monitoring activities whenever required by applicable law. Users remain solely responsible for complying with all legal notification, consent, transparency, and child protection obligations applicable within their jurisdiction.

Parents and legal guardians acknowledge that digital safety requires continuous involvement and that no technological solution, including Haris, can eliminate all online or offline risks. Haris should be used as one component of a broader child safety strategy that includes communication, education, supervision, responsible parenting, and age-appropriate guidance.

Failure to fulfill the responsibilities and obligations described in this section may reduce the effectiveness of the Services and, where applicable, may constitute a violation of these Terms.

13. Protection of Children and Responsible Use

Haris is designed to assist parents and legal guardians in promoting the digital safety, well-being, and responsible use of technology by children through transparent, privacy-conscious, and security-focused tools. The Services are intended solely to support lawful child protection activities and are not designed or intended for covert surveillance, unauthorized monitoring, or any activity inconsistent with the safety, dignity, rights, or best interests of children.

Parents and legal guardians acknowledge that the use of the Services should always respect the child's dignity, privacy, rights, evolving maturity, and age-appropriate level of understanding, while taking into account applicable laws, regulations, and legal obligations within the user's jurisdiction.

Users agree that the Services shall not be used:

  • To monitor any child without the legal authority required by applicable law.
  • To facilitate abuse, intimidation, harassment, coercion, retaliation, exploitation, discrimination, or any other unlawful or harmful conduct involving a child.
  • To interfere with the lawful rights, freedoms, privacy, or well-being of any child or any other individual.
  • To circumvent legal safeguards, parental responsibility requirements, court orders, or other legal protections established for children.
  • For any purpose inconsistent with the intended child safety objectives of the Services or these Terms.

Where applicable law requires that children or other affected individuals be informed of monitoring activities, parents and legal guardians remain solely responsible for providing any required notice, obtaining any legally required consent or authorization, and complying with all applicable notification, transparency, child protection, and privacy obligations.

Parents and legal guardians acknowledge that Haris supports responsible parenting but does not determine what constitutes appropriate parenting practices, legal custody arrangements, family relationships, educational decisions, or the best interests of any particular child. Such matters remain solely the responsibility of the parent, legal guardian, or other competent legal authority.

Nothing in these Terms authorizes, encourages, or permits the use of the Services in any manner that violates applicable child protection laws, privacy laws, family laws, criminal laws, court orders, educational regulations, or any other applicable legal obligation.

Where independent third-party providers process personal information on behalf of Haris in connection with the Services, such processing shall be governed by the Haris Privacy Policy, applicable contractual arrangements between Haris and the relevant provider, and applicable law. Haris endeavors to work with service providers that implement appropriate technical and organizational measures to protect personal information. However, Haris cannot guarantee the security, availability, performance, or continued operation of independent third-party systems that are outside Haris's reasonable control.

16. Intellectual Property and Proprietary Rights

The Services incorporate proprietary technologies developed by Haris together with certain third-party software, open-source software, artificial intelligence models, libraries, frameworks, software development kits (SDKs), and other technologies that are licensed or otherwise lawfully used by Haris in accordance with their respective license terms.

Except for such third-party components, all software developed by Haris, application architecture, proprietary workflows, security mechanisms, detection methodologies, automated analysis implementation, user interfaces, visual designs, documentation, databases, branding, trademarks, logos, service marks, trade dress, domain names, graphics, text, audiovisual materials, source code, object code, business logic, confidential information, trade secrets, know-how, and all other proprietary materials developed by or for Haris (collectively, the "Intellectual Property") are owned by Haris, its operator, its licensors, or other authorized rights holders and are protected by applicable intellectual property, copyright, trademark, patent, trade secret, unfair competition, and other applicable laws.

Nothing in these Terms shall be interpreted as claiming ownership by Haris over third-party software, open-source software, artificial intelligence models, libraries, frameworks, SDKs, or any other third-party intellectual property incorporated into the Services. Ownership of such technologies remains with their respective owners, licensors, or contributors and continues to be governed by their applicable license terms.

Except for the limited license expressly granted under Section 8 (License to Use the Services), nothing in these Terms transfers, assigns, licenses, conveys, or otherwise grants users any ownership interest, proprietary right, intellectual property right, or other legal interest in or to the Intellectual Property developed or owned by Haris.

Users shall not, directly or indirectly:

  • Copy, reproduce, modify, adapt, translate, distribute, publish, display, perform, transmit, create derivative works from, sell, license, sublicense, lease, assign, exploit, or otherwise commercially use any portion of the Intellectual Property except as expressly permitted by these Terms or applicable law.
  • Reverse engineer, decompile, disassemble, decode, inspect, analyze, reconstruct, extract, or otherwise attempt to discover the proprietary source code, application architecture, security implementation, detection methodologies, automated analysis implementation, business logic, proprietary workflows, databases, or other confidential technologies developed by Haris.
  • Remove, alter, obscure, or interfere with any copyright notice, trademark, logo, branding, licensing notice, proprietary marking, or other legal notice displayed within the Services.
  • Register, acquire, or attempt to acquire any trademark, trade name, domain name, social media account, or other identifier that is identical or confusingly similar to the Haris name, branding, or other Intellectual Property.
  • Use the Haris name, trademarks, logos, branding, trade dress, marketing materials, or other distinctive brand elements in any manner that suggests sponsorship, endorsement, affiliation, partnership, certification, or approval without the prior written authorization of Haris.

Feedback, suggestions, ideas, comments, feature requests, enhancement proposals, bug reports, security reports, usability recommendations, or other communications voluntarily submitted to Haris regarding the Services may be used, implemented, modified, reproduced, distributed, or incorporated into the Services by Haris without restriction and without any obligation to provide compensation, attribution, royalties, or other consideration to the submitting user, unless otherwise required by applicable law.

Nothing in these Terms shall be interpreted as granting any right to access, inspect, extract, reproduce, benchmark, analyze, train upon, or otherwise misuse the proprietary integration, implementation, application architecture, security mechanisms, detection methodologies, automated analysis implementation, workflows, business logic, or other proprietary technologies developed by Haris, except where expressly authorized in writing by Haris. This restriction does not limit any rights granted under the applicable licenses governing third-party open-source software or other third-party technologies incorporated into the Services.

Nothing in these Terms limits or waives any rights or remedies available to Haris under applicable intellectual property, copyright, trademark, patent, trade secret, unfair competition, contract, or other applicable laws.

Nothing in these Terms shall be interpreted as restricting, modifying, superseding, or otherwise affecting any rights granted to users under the applicable licenses governing third-party open-source software or other third-party components incorporated into or distributed with the Services. Such components remain subject to their respective license terms.

17. Disclaimer of Warranties and Service Availability

To the fullest extent permitted by applicable law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties, representations, or guarantees of any kind, whether express, implied, statutory, or otherwise. Haris makes no representation or warranty regarding the uninterrupted availability, reliability, accuracy, completeness, performance, security, compatibility, suitability, merchantability, fitness for a particular purpose, or non-infringement of the Services.

To the fullest extent permitted by applicable law, Haris expressly disclaims all warranties, including, without limitation:

  • Implied warranties of merchantability.
  • Fitness for a particular purpose.
  • Non-infringement.
  • Satisfactory quality.
  • Continuous availability.
  • Accuracy or completeness of information.
  • Error-free or uninterrupted operation.
  • Compatibility with every device, operating system, platform, network environment, or software configuration.

Without limiting the foregoing, Haris does not warrant or guarantee that:

  • The Services will operate continuously, without interruption, delay, degradation, or error.
  • Every harmful, inappropriate, abusive, illegal, or unsafe activity, communication, image, or behavior will be detected, classified, prevented, or reported.
  • Artificial intelligence analyses, automated detections, notifications, recommendations, or alerts will always be accurate, complete, timely, or appropriate.
  • The Services will remain compatible with every operating system version, device manufacturer implementation, hardware configuration, or third-party technology.
  • Security vulnerabilities, cyberattacks, malware, unauthorized access, or other digital threats can be completely prevented, detected, or eliminated.
  • Every notification, alert, communication, or synchronization event will be successfully delivered or received without delay.
  • The Services will satisfy every user's expectations, requirements, or intended outcomes.

Users acknowledge that the operation and effectiveness of the Services depend upon numerous factors beyond Haris's reasonable control, including operating system behavior, hardware capabilities, permissions granted or revoked by users, network availability, internet connectivity, third-party platforms and service providers, artificial intelligence limitations, device manufacturer restrictions, cybersecurity threats, regulatory changes, and other external technical or legal factors.

No oral or written statement, demonstration, marketing material, product description, documentation, recommendation, customer support communication, training material, or other information provided by Haris shall create any warranty, guarantee, or contractual commitment unless expressly incorporated into these Terms.

Users acknowledge that Haris provides technological tools intended to assist parents and legal guardians in promoting child safety but does not guarantee the prevention of harm, the elimination of digital risks, or the achievement of any specific safety outcome. The Services are designed to support, and not replace, appropriate parental supervision, communication, education, responsible decision-making, or the exercise of independent judgment.

Nothing in these Terms excludes, limits, or modifies any warranty, guarantee, consumer right, or other legal protection that cannot lawfully be excluded or limited under applicable law.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Haris, its operator, licensors, affiliates, contractors, service providers, employees, officers, directors, representatives, successors, assigns, and agents shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising out of or relating to the use of, inability to use, unavailability of, or reliance upon the Services, regardless of the legal theory upon which the claim is based, including contract, tort (including negligence), strict liability, statutory liability, or otherwise.

Without limiting the foregoing, Haris shall not be liable for any loss, damage, liability, cost, or expense arising from or relating to:

  • Failure to detect, classify, prevent, report, or respond to harmful, inappropriate, abusive, illegal, unsafe, or otherwise undesirable content, communications, images, activities, or behavior.
  • False positives, false negatives, inaccurate classifications, delayed alerts, missed notifications, synchronization delays, or other limitations inherent in artificial intelligence or automated analysis technologies.
  • Decisions, actions, or omissions by parents, legal guardians, children, or other users based upon information, recommendations, alerts, notifications, or analyses provided by the Services.
  • Loss, corruption, delay, interruption, unauthorized modification, or unavailability of data, notifications, communications, locally stored information, or other digital content.
  • Temporary or permanent interruption, suspension, modification, degradation, discontinuation, or reduced functionality of the Services or any feature thereof.
  • Operating system updates, device manufacturer restrictions, hardware failures, software conflicts, network outages, internet disruptions, cloud service interruptions, third-party technology failures, or other circumstances beyond Haris's reasonable control.
  • Cybersecurity incidents, malware, ransomware, unauthorized access, denial-of-service attacks, data breaches, or other digital threats, except to the extent directly resulting from Haris's fraud, willful misconduct, or gross negligence where such exclusions are prohibited by applicable law.
  • Loss of profits, revenue, business opportunities, anticipated savings, goodwill, reputation, productivity, business interruption, or any other economic, commercial, indirect, incidental, consequential, special, exemplary, punitive, or intangible loss.

To the fullest extent permitted by applicable law, Haris's aggregate cumulative liability arising out of or relating to the Services shall not exceed the total amount, if any, actually paid directly by the user to Haris for the Services during the twelve (12) months immediately preceding the event giving rise to the claim.

Users acknowledge that the pricing of the Services, including any free access, promotional access, trial access, or future paid subscription plans, reflects the allocation of risk established by these Terms. The limitations and exclusions of liability contained in this section constitute an essential basis of the agreement between the parties and shall survive the termination or expiration of these Terms to the fullest extent permitted by applicable law.

Nothing in these Terms excludes, limits, or restricts any liability that cannot lawfully be excluded or limited under applicable law, including liability arising from fraud, fraudulent misrepresentation, willful misconduct, gross negligence where applicable law prohibits limitation, or any other liability that applicable law requires to remain enforceable.

19. Indemnification

To the fullest extent permitted by applicable law, users agree to defend, indemnify, and hold harmless Haris, its operator, licensors, affiliates, contractors, service providers, employees, officers, directors, representatives, successors, assigns, and agents from and against any claims, demands, actions, proceedings, investigations, judgments, liabilities, damages, losses, settlements, fines, penalties, costs, and expenses, including reasonable legal fees and litigation expenses, arising out of or relating to:

  • The user's access to, use of, misuse of, or inability to properly use the Services.
  • Any violation of these Terms or any other policies or agreements incorporated into these Terms.
  • Any violation of applicable laws, regulations, court orders, governmental requirements, or legally binding obligations.
  • The unauthorized, unlawful, deceptive, or improper monitoring or supervision of any individual.
  • Any infringement or alleged infringement of the rights of another person or entity, including privacy rights, intellectual property rights, publicity rights, contractual rights, or any other legal rights.
  • Information, content, communications, images, files, or other materials submitted, transmitted, stored, processed, or otherwise made available by the user through or in connection with the Services.
  • The user's negligence, misconduct, fraud, willful misconduct, unlawful conduct, or other wrongful acts or omissions.
  • Any claim arising from actions, decisions, or omissions by the user based upon information, recommendations, alerts, notifications, automated analyses, or other outputs generated by the Services.
  • Any dispute between the user and another individual, parent, legal guardian, child, educational institution, employer, governmental authority, or other third party arising from the user's use of the Services.

This indemnification obligation applies only to the extent that the relevant claim, loss, liability, or expense results from the user's own acts or omissions. It does not apply to the extent that a claim arises directly from Haris's fraud, fraudulent misrepresentation, willful misconduct, or gross negligence where applicable law prohibits the exclusion or limitation of such liability.

Haris reserves the right, at its own expense, to assume the exclusive defense, control, negotiation, and settlement of any matter otherwise subject to indemnification under this section. Where Haris exercises this right, users agree to cooperate reasonably, provide relevant information where lawfully requested, and refrain from taking any action that could materially prejudice Haris's defense of the matter.

Nothing in this section shall require users to admit liability, waive any legal rights or defenses, or settle any claim without their consent where such consent is required by applicable law.

Nothing in this section shall require a user to indemnify Haris for claims arising solely from Haris's own violation of applicable law or from obligations that cannot lawfully be transferred, excluded, or limited under applicable law.

The obligations contained in this section shall survive the suspension, termination, expiration, discontinuation, or deletion of the user's account, the Services, or these Terms to the fullest extent permitted by applicable law.

20. Account Suspension, Termination, and Service Access

To the fullest extent permitted by applicable law, Haris reserves the right to suspend, restrict, limit, terminate, or otherwise modify a user's access to all or any part of the Services where Haris reasonably believes that such action is necessary to protect the security, integrity, availability, lawful operation, or users of the Services, to comply with applicable law, or to safeguard the legitimate interests of Haris or third parties.

Without limiting the foregoing, Haris may suspend, restrict, terminate, or otherwise limit access where Haris reasonably believes that:

  • The user has violated these Terms, the Privacy Policy, or any other applicable Haris policies or agreements.
  • The Services are being used in an unlawful, fraudulent, deceptive, abusive, harmful, or unauthorized manner.
  • The user has provided false, inaccurate, misleading, or fraudulent registration or account information.
  • Monitoring activities are conducted without lawful authority or otherwise violate applicable law.
  • Continued access presents a security, privacy, operational, or legal risk to Haris, other users, children, third-party providers, or the operation of the Services.
  • A competent governmental authority, court, regulator, platform provider, or other legally authorized body requires Haris to suspend, restrict, or terminate access.
  • Continued operation would violate applicable law, platform requirements, contractual obligations, security requirements, or the rights of another individual.

Where reasonably practicable and appropriate, Haris may provide notice before suspending or terminating an account. However, Haris may immediately suspend, restrict, or terminate access without prior notice where Haris reasonably believes that immediate action is necessary to:

  • Protect the security or integrity of the Services.
  • Prevent imminent harm or misuse.
  • Investigate suspected violations of these Terms or applicable law.
  • Comply with legal obligations or binding requests from competent authorities.
  • Respond to security incidents, fraud, abuse, or other emergency situations.

Users may discontinue their use of the Services at any time. Subject to the functionality made available within the Services, users may also request deletion of their accounts in accordance with the Haris Privacy Policy and applicable account management procedures.

Suspension or termination of an account does not automatically require the deletion of information where Haris is required or permitted by applicable law to retain certain information for security, fraud prevention, legal compliance, dispute resolution, enforcement of these Terms, or the establishment, exercise, or defense of legal claims. The collection, retention, deletion, and protection of personal information remain governed by the Haris Privacy Policy.

Where reasonably necessary to protect the Services or comply with applicable law, Haris may revoke authentication credentials, terminate active sessions, disable device pairing, restrict access to specific features, suspend synchronization, or implement other reasonable technical or administrative measures associated with account suspension or termination.

Where appropriate and technically feasible, Haris may, at its sole discretion, permit users to remedy certain violations of these Terms or restore access following a suspension. Nothing in this section obligates Haris to reinstate any account, restore any content, re-establish device pairing, or re-enable access where Haris reasonably determines that continued suspension, restriction, or termination is necessary to protect the Services, comply with applicable law, safeguard users or third parties, or protect Haris's legitimate interests.

Termination, suspension, restriction, or modification of access does not affect any provision of these Terms that, by its nature or intended purpose, survives termination, including provisions relating to intellectual property, confidentiality, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, payment obligations (if applicable), and any accrued rights or obligations.

21. Governing Law and Dispute Resolution

These Terms, the Services, and any dispute, claim, controversy, or legal proceeding arising out of or relating to these Terms, the Services, or the relationship between the user and Haris shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt, without regard to its conflict of law principles, except to the extent that mandatory laws of another jurisdiction apply and cannot lawfully be excluded or limited.

The parties agree to make reasonable, good-faith efforts to resolve any dispute, claim, or controversy through informal discussions before commencing formal legal proceedings, unless immediate legal action is reasonably necessary to preserve legal rights, prevent imminent harm, comply with applicable law, or seek urgent judicial relief.

If a dispute cannot be resolved through informal discussions within a reasonable period, either party may pursue any remedies available under applicable law before the courts of competent jurisdiction within the Arab Republic of Egypt, unless mandatory consumer protection laws or other non-waivable legal requirements require that the dispute be heard in another competent jurisdiction.

Nothing in these Terms prevents either party from seeking temporary, preliminary, interlocutory, injunctive, conservatory, or other equitable relief where such relief is reasonably necessary to:

  • Prevent irreparable harm.
  • Protect confidential information or trade secrets.
  • Protect intellectual property rights.
  • Preserve evidence.
  • Maintain the status quo pending final resolution.
  • Comply with applicable law or a lawful order of a competent authority.

Nothing in these Terms excludes, limits, or waives any jurisdictional rights, legal remedies, or consumer protections that cannot lawfully be excluded or limited under applicable law. Where mandatory law grants users additional rights relating to jurisdiction, venue, dispute resolution, or legal remedies, those rights shall prevail to the extent required by law.

If any provision of this section is determined by a court or other competent authority to be invalid, illegal, unenforceable, or inapplicable within a particular jurisdiction, such determination shall not affect the validity, legality, or enforceability of the remaining provisions of these Terms or the application of this section in any other jurisdiction, to the fullest extent permitted by applicable law.

22. Entire Agreement and Severability

These Terms, together with the Haris Privacy Policy and any other policies, guidelines, notices, or documents expressly incorporated by reference, constitute the complete and entire agreement between the user and Haris concerning the Services. They supersede and replace all prior or contemporaneous communications, discussions, negotiations, proposals, understandings, representations, warranties, promises, agreements, or arrangements, whether oral, written, electronic, or otherwise, relating to the same subject matter.

Users acknowledge that, except as expressly stated in these Terms or the documents incorporated by reference, they have not relied upon any representation, statement, promise, warranty, marketing material, demonstration, presentation, support communication, or other information when deciding to access or use the Services.

If any provision of these Terms, or any part thereof, is determined by a court or other competent authority to be invalid, illegal, unenforceable, or incapable of being enforced under applicable law, that provision shall, to the fullest extent legally permissible, be interpreted, modified, or limited in a manner that most closely reflects its original purpose while remaining valid and enforceable.

If such interpretation, modification, or limitation is not legally possible, the affected provision shall be deemed severed only to the minimum extent necessary. The remaining provisions of these Terms shall remain in full force and effect and shall continue to be valid, enforceable, and binding.

The invalidity, illegality, unenforceability, or inapplicability of any provision in one jurisdiction shall not affect the validity, legality, enforceability, or applicability of that provision or any other provision in any other jurisdiction, to the fullest extent permitted by applicable law.

No failure, delay, partial exercise, or omission by Haris in exercising any right, remedy, power, or privilege under these Terms shall constitute or be interpreted as a waiver of that right or any other right. Any waiver shall be effective only if made expressly in writing by Haris and shall apply only to the specific matter for which it was granted.

The section titles and headings used throughout these Terms are provided solely for convenience, organization, and ease of reference. They shall not affect, limit, expand, or otherwise influence the interpretation, scope, or meaning of any provision contained in these Terms.

23. Notices and Contact Information

Haris may provide users with notices relating to the Services, these Terms, the Privacy Policy, account activity, security matters, legal or regulatory requirements, maintenance activities, feature updates, or other operational matters through the Services, electronic mail, in-application notifications, push notifications, the official Haris website, or any other reasonable electronic communication method permitted by applicable law.

Users are responsible for ensuring that the contact information associated with their accounts, including their email address and any other designated communication methods, remains accurate, complete, and up to date. Haris shall not be responsible for any delay, failed delivery, or other consequence resulting from a user's failure to maintain accurate contact information.

Where these Terms require or permit users to provide notices or communications to Haris, such notices shall be submitted through the contact methods designated by Haris from time to time, unless another method is required by applicable law.

Official legal notices, privacy-related requests, data protection inquiries, intellectual property notices, security vulnerability reports, regulatory communications, or other legal matters may be directed to Haris through the contact channels published within the Services or on the official Haris website.

For operational efficiency and user convenience, Haris may maintain separate communication channels for customer support, privacy matters, legal notices, intellectual property matters, security vulnerability reporting, regulatory communications, billing inquiries (where applicable), and other specialized requests. The availability or use of specialized communication channels does not affect the validity of notices otherwise provided in accordance with these Terms or applicable law.

Haris may update its contact information, communication channels, or designated methods for receiving notices from time to time. Updated contact details published through the Services or the official Haris website shall replace previously published contact information without requiring a formal amendment to these Terms.

Nothing in this section limits or affects any notice, disclosure, communication, or information that Haris is required to provide under applicable law.

24. Miscellaneous Provisions

Nothing in these Terms shall be interpreted as creating any partnership, joint venture, agency, employment, fiduciary, franchise, or other similar relationship between the user and Haris. Users access and use the Services solely as independent users in accordance with these Terms.

Haris may assign, transfer, delegate, or otherwise transfer its rights or obligations under these Terms, in whole or in part, in connection with a merger, acquisition, incorporation, corporate restructuring, financing transaction, sale of assets, or transfer of the Services, provided that such transfer does not reduce any mandatory legal rights afforded to users under applicable law. Users may not assign, transfer, delegate, sublicense, or otherwise transfer any rights or obligations under these Terms without Haris's prior written consent.

Haris shall not be liable for any delay, interruption, failure to perform, or inability to provide the Services where such delay or failure results from circumstances beyond Haris's reasonable control, including natural disasters, floods, fires, earthquakes, epidemics, pandemics, war, terrorism, civil unrest, labor disputes, governmental actions, judicial orders, interruptions to telecommunications or internet infrastructure, widespread cybersecurity incidents, failures of utility services, failures of third-party infrastructure, or other force majeure events. Haris will use commercially reasonable efforts to resume normal operation of the Services as soon as reasonably practicable after such circumstances cease.

Where permitted by applicable law, users acknowledge and agree that accepting these Terms electronically, including by creating an account, selecting an acceptance option, downloading, installing, accessing, or continuing to use the Services, constitutes a legally binding agreement and has the same legal force and effect as a handwritten signature.

These Terms may be translated into languages other than Arabic for user convenience. In the event of any conflict, inconsistency, or ambiguity between the Arabic version and any translated version, the Arabic version shall prevail to the fullest extent permitted by applicable law.

Nothing in these Terms shall be interpreted as limiting, excluding, or affecting any rights, remedies, obligations, or protections that cannot lawfully be waived, excluded, or limited under applicable law.

These Terms shall be interpreted as a whole, and each provision shall be construed in a manner that gives effect to the overall purpose of the agreement without rendering any provision ineffective, meaningless, or inconsistent with applicable law.
